Terms and Conditions

Effective 13 August 2026 · Version 1.1. By purchasing or using our Products You agree to these Terms. If You do not agree, do not use the Products.

This English version is the official text of these Terms. The French and Spanish versions are provided for convenience only; in the event of any discrepancy, the English version governs.

Interpretation and Definitions

Words with capitalized initials have the meanings given below, in the singular or the plural:

  • Affiliate: Any entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of 50% or more of voting shares or securities.
  • Company / We / Us / Our: Exhaust IQ, the seller of the Products.
  • Products: The diagnostic tools, test fluids, chemical reagents, and related goods sold by Exhaust IQ.
  • Report: The optional AI-generated analysis available through the Website.
  • Terms: This agreement between You and Exhaust IQ regarding the purchase and use of the Products.
  • Website: exhaustiq.com.
  • You: The individual or entity purchasing or using the Products.

Acknowledgment

By purchasing or using our Products You agree to be bound by these Terms. If You do not agree, do not use or purchase our Products. You must be at least 18 years old to purchase from Exhaust IQ. Use of the Website is also governed by our Privacy Policy at exhaustiq.com/privacy.

Safety Warnings and Personal Injury Disclaimer

WARNING: AUTOMOTIVE DIAGNOSTICS INVOLVE SIGNIFICANT RISKS. By using our Products You acknowledge that You are working with vehicle engines that present inherent dangers. You agree to the following:

  1. Pressurized cooling systems. You acknowledge the risk of severe scalding and burns. NEVER remove a radiator cap or expansion tank cap while the engine is warm or hot. Where a test requires the cooling system to be opened, You agree to wait until the engine is completely cool before removing any cap or fitting equipment. Where the supplied instructions direct You to run the engine with the pressure cap removed, You agree to follow those instructions exactly, to stand clear of the open neck, and to treat the neck, hoses and coolant as hot from that point on. Engine surfaces, the dipstick tube and exhaust components also stay hot after running.
  2. Moving parts. You agree to keep hands, hair, clothing, tools and the Product tubing away from radiator fans, drive belts and pulleys whenever the engine is running, and to secure the vehicle against movement before revving the engine.
  3. Chemical handling. The test fluid supplied with the Product is a chemical substance. You agree to handle it with care, to avoid contact with skin and eyes, to keep it away from children and pets, and not to ingest it. First aid: on skin or eye contact, rinse with water for at least 15 minutes and seek medical advice; if swallowed, do not induce vomiting and seek medical advice immediately. Disposal: dispose of used fluid and vials in accordance with local regulations; do not pour into drains or waterways. A Safety Data Sheet is available on request at info@exhaustiq.com.
  4. Ventilation. You agree to operate the vehicle engine only outdoors or in a well-ventilated area, to avoid carbon monoxide poisoning.

To the extent permitted by law, and subject to the section “Rights That Cannot Be Excluded” below, Exhaust IQ is not responsible for injury, loss or damage resulting from Your failure to follow standard automotive safety practices or the instructions supplied with the Product.

Product Information and Intended Use

We make reasonable efforts to describe our Products accurately. The information they provide is for diagnostic and informational purposes only. You acknowledge and agree that:

  • Results are indicators, not guarantees of vehicle or engine condition.
  • A “good” result (for example, test fluid remaining blue) does not guarantee a vehicle is free of defects, and a “bad” result (for example, test fluid turning yellow) is not a definitive condemnation of the engine without further professional inspection.
  • Printed colour reference scales can shift with printer, ink and paper; where accuracy matters, use the reference scale published on the Website or the Report.
  • Our Products are not a substitute for professional mechanical inspection or maintenance.
  • You are solely responsible for how You use the results, including any repair, purchase or operational decision.

AI Reports and Online Tools

The Report is an optional feature offered free of charge as a convenience. It is generated by automated analysis of the image and information You submit. You acknowledge and agree that:

  • The Report is an estimate for informational purposes only and is not professional, mechanical, safety or financial advice, and not a substitute for inspection by a qualified mechanic.
  • Automated analysis can be affected by lighting, image quality, timing and vehicle-specific factors, and may be wrong.
  • We do not warrant that the Report will be accurate, uninterrupted or available, and we may change, suspend or discontinue it at any time without notice.
  • Submitting an image is governed by the section “Your Content and Sample Data” below.

Customer Responsibility for Use

By using our Products You agree that:

  • You are solely responsible for following all instructions and ensuring safe, proper use.
  • Misuse — including inserting tubes or components into the wrong location (such as vacuum lines, oil dipsticks or fuel lines), applying excessive force, or failing to follow directions — can cause damage to a vehicle or engine.
  • Subject to the section “Rights That Cannot Be Excluded”, Exhaust IQ is not responsible for damage, breakdown or failure arising from misuse, inexperience or user error.
  • If You are not confident in using the Products correctly, seek assistance from a qualified professional mechanic.

Orders, Pricing and Delivery

  • Prices are shown in the currency stated at checkout and may change at any time before an order is placed. Obvious pricing or description errors may be corrected, and we may cancel and refund an affected order.
  • All orders are subject to acceptance and availability. We may refuse or cancel an order and issue a full refund.
  • Delivery dates are estimates and are not guaranteed. Risk of loss passes to You on delivery.
  • Any import duties, customs charges or taxes levied on delivery outside our country of dispatch are Your responsibility.

Returns and Refunds

  • Return window: unopened, unused Products may be returned within 30 days of delivery.
  • Opened or used Products are not eligible for return, for safety and contamination reasons, unless the Product arrived defective or damaged (for example broken glassware or leaking fluid on delivery).
  • Damaged or defective on arrival: contact us within 7 days of delivery with photographs of the item and packaging. We will arrange a replacement or refund and may ask You to return the item or to dispose of it safely.
  • Return shipping is paid by You for change-of-mind returns, and by Exhaust IQ where the Product was defective, damaged or incorrectly supplied.
  • Process: contact info@exhaustiq.com before returning anything, so we can issue return instructions.
  • Refunds are issued to the original payment method, normally within 10 business days of the return being received and inspected, or of a damage claim being approved.

This policy is in addition to, and does not limit, any refund or repair rights You have under applicable consumer law.

Intellectual Property

The Product design, the “Exhaust IQ” brand, the Website, and its original content, features and functionality are and remain the exclusive property of Exhaust IQ and its licensors. The Product may not be reverse-engineered, copied or reproduced without our prior written consent.

Your Content and Sample Data

“User Content” means any image, photo, video, sample result or related information You upload or send to us — for example a photograph of a test vial submitted for a Report. You keep ownership of Your User Content. You grant Exhaust IQ a worldwide, royalty-free, non-exclusive licence to store, reproduce, analyse and adapt it for these purposes only:

  • to generate and deliver Your Report and provide customer support;
  • to improve, test and develop our Products, services and diagnostic models, including training our own analytical models; and
  • to create aggregated or de-identified data sets and reference material, which we may publish or share. De-identified means the material can no longer reasonably be linked to You or Your vehicle.

We do not sell Your User Content or Your personal information to third parties. We share it only with service providers who host or process it on our behalf under confidentiality obligations, and where we are required to do so by law.

Business transfer. If Exhaust IQ is sold, merged, restructured, or if all or part of its business or assets are acquired — or in the course of due diligence for any such transaction — User Content, customer records and associated data may be transferred to or shared with the other party as part of that transaction, subject to appropriate confidentiality protections. Any acquirer will be bound by these Terms in respect of that material until You are notified of, and given any choice required by law about, a change in how it is handled.

You may ask us to delete Your User Content at any time by emailing info@exhaustiq.com, and we will do so within a reasonable period — except for copies already incorporated into aggregated or de-identified data sets, which cannot be separated out, and copies we are required to retain by law.

You represent and warrant that You have the rights needed to submit Your User Content and that it does not infringe any third-party rights. Please avoid capturing licence plates, vehicle identification numbers, faces or other identifying details in photographs You send us.

Privacy

Personal information is collected, used and disclosed in accordance with our Privacy Policy at exhaustiq.com/privacy, which forms part of these Terms. Depending on where You live, You may have rights to access, correct, delete or port Your personal information, or to object to certain uses of it. To exercise any of these rights, contact info@exhaustiq.com.

Rights That Cannot Be Excluded

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or under any non-excludable consumer guarantee or statutory right. Some jurisdictions do not allow the exclusion of implied warranties or the limitation of incidental or consequential damages, so some provisions below may not apply to You. Nothing in these Terms affects Your statutory rights as a consumer.

Limitation of Liability

Subject to the section above, and to the maximum extent permitted by law, Exhaust IQ and its Affiliates shall not be liable for any loss, damage or expense arising from the purchase, use or misuse of the Products or any Report, including without limitation:

  • vehicle or engine damage caused during testing, including incorrect installation or use of sampling tubes, gaskets or accessories,
  • vehicle or engine failure, breakdown or repair costs after testing,
  • loss of vehicle value, towing, rental, storage or related costs,
  • decisions to buy, sell, repair or continue operating a vehicle made on the basis of a test result or Report,
  • indirect, incidental, special, punitive or consequential damages of any kind.

Our total aggregate liability to You shall not exceed the amount You paid for the Product giving rise to the claim, or US$100 if no purchase was made. By using the Products You assume the ordinary risks of operating them in accordance with the instructions.

Disclaimer of Warranties

THE PRODUCTS AND ANY REPORT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXHAUST IQ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND ANY WARRANTY AS TO THE ACCURACY OR RELIABILITY OF RESULTS. WE DO NOT WARRANT THAT RESULTS WILL PREVENT OR PREDICT VEHICLE ISSUES, OR THAT THE PRODUCTS WILL ESTABLISH THE CONDITION, SAFETY OR PERFORMANCE OF ANY VEHICLE.

Some jurisdictions do not allow the exclusion of implied warranties or limits on how long an implied warranty lasts. Where that is the case, the exclusions above do not apply to You, and any implied warranty is limited to the shortest period permitted by that law. Products that arrive damaged or defective are dealt with under “Returns and Refunds” above.

Indemnification

You agree to indemnify and hold harmless Exhaust IQ and its Affiliates from any third-party claim, loss or expense (including reasonable legal fees) arising from Your misuse of the Products, Your breach of these Terms, or Your User Content — except to the extent the claim results from our own negligence or breach.

Links to Other Websites

Our Website may contain links to third-party websites or services. We do not control and are not responsible for their content, policies or practices.

Termination

We may suspend or terminate Your ability to purchase Products if You breach these Terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Alberta, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the jurisdiction of the courts of Alberta. If You are a consumer, this choice of law does not deprive You of the protection of the mandatory consumer-protection laws of the state, province or country where You habitually reside, and nothing here prevents You from bringing proceedings in Your local courts where applicable law gives You that right.

Dispute Resolution

Before starting any formal proceeding, You agree to send a written notice of dispute to info@exhaustiq.com describing the issue and the resolution You are seeking, and to allow 30 days for us to resolve it informally. We will do the same before bringing a claim against You. To the extent permitted by law, any claim must be brought within one year of the event giving rise to it.

Legal Compliance

By purchasing Products You represent and warrant that You comply with applicable laws in Your jurisdiction, that You are not located in a restricted country or on a prohibited-party list, and that export or import of the Products is Your responsibility.

Force Majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural events, labour disruption, carrier failure, or interruption of utilities or communications networks.

Severability, Assignment and Waiver

If any provision is found unenforceable, it will be applied to the maximum extent permitted and the remainder will stay in effect. Failure to enforce any right is not a waiver of it. You may not assign these Terms without our consent; we may assign them to an Affiliate or to an acquirer of our business.

Entire Agreement and Changes

These Terms, together with the Privacy Policy and the instructions supplied with the Product, are the entire agreement between You and Exhaust IQ regarding the Products. We may update these Terms; the current version, with its effective date, is always posted at exhaustiq.com/terms-conditions, and material changes will be highlighted there. The version in force when You place an order governs that order.
