Words with capitalized initials have specific meanings defined here. These definitions apply whether used in singular or plural form.

Definitions

For the purposes of these Terms and Conditions:

  • Products: The diagnostic tools, test fluids, chemical reagents, and related goods sold by Exhaust IQ through its Website.

  • Terms and Conditions / Terms: This agreement between You and the Company regarding the purchase and use of the Products.

  • You: The individual or entity purchasing or using the Products.

Acknowledgment

By purchasing or using our Products, You agree to be bound by these Terms. If You do not agree, do not use or purchase our Products. You must be at least 18 years old to purchase from Exhaust IQ. Use of the Website is also governed by our Privacy Policy.

Safety Warnings and Personal Injury Disclaimer

WARNING: AUTOMOTIVE DIAGNOSTICS INVOLVE SIGNIFICANT RISKS. By using our Products, You acknowledge that You are working with vehicle engines that present inherent dangers. You strictly agree to the following safety protocols:

  1. Pressurized Cooling Systems: You acknowledge the risk of severe scalding and burns. NEVER remove a radiator cap or expansion tank cap while the engine is hot. You agree to wait until the engine is completely cool before installing any test equipment.

  2. Moving Parts: You acknowledge the risk of injury from moving engine components. You agree to keep hands, hair, clothing, and the Product tubing away from radiator fans, drive belts, and pulleys while the engine is running.

  3. Chemical Handling: The test fluid provided with the Product is a chemical substance. You agree to handle it with care, avoid contact with skin and eyes, keep it out of reach of children and pets, and do not ingest it.

  4. Ventilation: You agree to only operate the vehicle engine in a well-ventilated area to avoid carbon monoxide poisoning.

Exhaust IQ is not liable for any personal injury, burns, dismemberment, or death resulting from Your failure to follow standard automotive safety practices or the specific instructions provided with the Product.

Product Information and Intended Use

We make reasonable efforts to describe our Products accurately. While we stand behind their quality, the information they provide is for diagnostic and informational purposes only.

You acknowledge and agree that:

  • Product results should be interpreted as indicators, not guarantees of vehicle or engine condition.

  • A “good” result (e.g., test fluid remaining blue) does not guarantee a vehicle is free of defects, and a “bad” result (e.g., test fluid turning yellow) is not a definitive condemnation of the engine without further professional inspection.

  • Our Products are not a substitute for professional mechanical inspection or maintenance.

  • You are solely responsible for how You use the results, including any repair, purchase, or operational decisions.

Customer Responsibility for Use

By using our Products, You agree that:

  • You are solely responsible for following all instructions and ensuring safe, proper use.

  • Misuse — including inserting tubes or components into the wrong location (such as vacuum lines, oil dipsticks, or fuel lines), applying excessive force, or failing to follow directions — can cause damage to a vehicle or engine.

  • Exhaust IQ is not responsible for any damage, breakdown, or failure that occurs during or as a result of using the Products, whether caused by misuse, inexperience, or error by the user.

  • If You are not confident in using the Products correctly, You should seek assistance from a qualified professional mechanic.

Returns and Refunds

  • Return Window: Products may be returned within 30 days of purchase.

  • Condition: Opened or used Products are not eligible for return, unless the Product arrived defective or damaged (e.g., broken glassware or leaking fluid upon delivery).

  • Defective Items: If Your Product arrives damaged, You must provide photographic evidence to us within 48 hours of delivery to be eligible for a replacement or refund.

  • Process: To initiate a return, contact us at info@exhaustiq.com.

  • Refunds: Refunds will be issued to the original payment method once the Product is received and inspected.

Intellectual Property

The Product design, the “Exhaust IQ” brand, the Website, and its original content, features, and functionality are and will remain the exclusive property of Exhaust IQ and its licensors. The Product may not be reverse-engineered, copied, or reproduced without our prior written consent.

Links to Other Websites

Our Website may contain links to third-party websites or services. We do not control and are not responsible for their content, policies, or practices.

Termination

We may suspend or terminate Your ability to purchase Products if You breach these Terms.

Limitation of Liability

To the maximum extent permitted by law: Exhaust IQ and its Affiliates shall not be liable for any loss, damage, or expense arising from the purchase, use, or misuse of the Products. This includes, without limitation:

  • Personal injury or bodily harm caused by hot fluids, pressurized caps, or moving engine parts,

  • Vehicle or engine damage caused during testing (including incorrect installation or use of sampling tubes or accessories),

  • Vehicle or engine failure, breakdown, or repair costs after testing,

  • Loss of vehicle value, towing, rental, storage, or related costs,

  • Indirect, incidental, special, or consequential damages of any kind.

Our total liability to You shall not exceed the amount You paid for the Product, or $100 USD if no purchase was made. By using the Products, You expressly assume all risk of operation and agree that Exhaust IQ provides Products strictly on an “AS IS” basis for informational purposes only.

Disclaimer of Warranties

Products are provided “AS IS” and “AS AVAILABLE.” We make no warranties, express or implied, including fitness for a particular purpose, merchantability, or accuracy of results. While our Products are designed to provide useful insights, they do not guarantee the condition, safety, or performance of any vehicle. Exhaust IQ does not warrant that results will prevent or predict future vehicle issues.

Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles. You explicitly agree to submit to the exclusive jurisdiction of the courts located in Alberta for the resolution of any disputes.

Dispute Resolution

You agree to first attempt to resolve any disputes informally by contacting info@exhaustiq.com.

Legal Compliance

By purchasing Products, You represent and warrant that:

  • You comply with applicable laws in Your jurisdiction.

  • You are not located in a restricted country or on a prohibited-party list.

  • Export or import of Products is Your responsibility.

Severability and Waiver

If any provision is found unenforceable, the remainder will remain in effect. Failure to enforce any right does not constitute a waiver.

Changes to Terms

We may update these Terms at any time. Continued use of the Website or Products constitutes acceptance of the updated Terms.

User Image and Data Submission Rights

By uploading, submitting, or otherwise providing any image, photo, video, or sample data (“User Content”) — including but not limited to photographs of test vials or diagnostic samples — You grant Exhaust IQ a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, copy, modify, adapt, analyze, publish, distribute, publicly display, commercialize, and sell such User Content and any related analytical data for any purpose, including research, development, marketing, AI training, or resale to third parties.

You acknowledge and agree that Exhaust IQ may, at its sole discretion, share, license, or sell such User Content and derived data to third parties without notice or compensation to You. You further represent and warrant that You have all necessary rights and permissions to grant this license and that Your submission does not infringe on any third-party rights.

Privacy and Data Usage Notice

All data and images submitted through our Website are processed in accordance with our Privacy Policy. By using the Website and submitting data, You consent to our collection, storage, analysis, and potential commercial use of that data as described in these Terms and the Privacy Policy.
